About Attorney Referrals
There are times when the best interests of your client means working with another law firm that has more experience in specific types of cases; greater familiarity with local laws, judges and juries; possesses the requisite legal credentials of a particular state; or which simply can provide additional and/or complementary resources that will maximize your opportunity for success. This is true whether you are referring a case to another firm, seeking co-counsel opportunities or as an out-of-state firm, simply looking for local counsel support.
We also recognize that every case referred to us is unique. In some situations, another firm may wish to serve as lead counsel, while in others; we are requested to fill that role. For some clients, the case may simply be handed off to us, while for others, the firm may wish that it be kept abreast of the case’s status every step of the way. Our philosophy with respect to working with other attorneys is guided by two principles. First, we understand that every firm brings unique resources, perspectives and experiences to each legal matter. It is the blending of these collective strengths that can often make the difference in a case. Second, we appreciate the relationship a law firm already enjoys with a referred client and will always respect and honor that relationship.
A large part of our client base results from attorney referrals in all types of Plaintiffs’ cases. In addition, our worker’s compensation practice section accepts cases on a referral and co-counsel basis, paying referral and co-counsel fees per the Indiana Rules of Professional Conduct.
ADVANTAGES OF ATTORNEY REFERRAL TO DELVENTHAL LAW OFFICE
- Diligent updates by email
Have you ever referred a case to another attorney and found that you never hear from that attorney again, or you only hear from them if you make repeated inquires? Not with our firm. We will keep you informed on the status of your referral on a regular basis by email. If you refer multiple cases to our firm, we will send you a quarterly spreadsheet with case status, anticipated date of resolution, and anticipated attorney fees.
- Flexible referral and co-counsel fees
Indiana ethical rules allow for a fee split between attorneys not in the same firm as long as (1) each attorney assumes joint responsibility for the representation, (2) the client agrees to the arrangement, including the share each attorney will receive, in writing, and (3) the total fee is reasonable. See Indiana Rule of Professional Conduct 1.4(e), as amended and effective January 1, 2005.
Our philosophy is to be flexible when agreeing to a fee split or co-counsel fee, depending on your ongoing involvement in the case, who pays expenses, and the overall value of the claim. When the case you refer settles or we obtain a judgment and collect our attorney fee, we will immediately send you a check for the referral or co-counsel fees, along with a settlement sheet outlining the client’s distribution.
