What happened
The Vanderburgh County sheriff has publicly described how a student came to be struck by a school bus at a bus stop in the Grandin Pointe mobile home park off North Saint Joseph Avenue in unincorporated northern Vanderburgh County. WFIE 14 News reported the account[1] on September 8, 2026, as an update to its coverage of the September 1 crash. The Tri-State Homepage newsroom also covered the crash[2].
According to WFIE 14 News, Sheriff Noah Robinson said the student was dropped off by one school bus in the parking lot, bent down to adjust a backpack, and was struck and dragged underneath a second bus that pulled in and began to turn around. The crash happened at about 2:57 p.m. on Tuesday, September 1, 2026, at school dismissal time.
WFIE 14 News reported that the student underwent three surgeries on September 8 alone and is expected to remain hospitalized for at least three months. The reported injuries are a severe pelvic fracture, a dislocated hip, and internal injuries. The student was taken to Riley Hospital for Children in Indianapolis and remains there, according to WFIE. An earlier WFIE report[3] also covered the student's transfer to Indianapolis.
The Vanderburgh County Sheriff's Office[4] is investigating, and the McCutchanville Fire Department responded. Evansville Vanderburgh School Corporation operates the buses. No citation has been reported, no formal finding of fault has been made public, and the driver of the second bus has not been named by any source.
Because this involves an injured child, this post does not report the student's name, age, school, or other identifying details. The legal information below is general information for families facing a similar situation.

What Should Accident Victims Do Next?
When a child is hurt by a public school bus in Indiana, you may face a much shorter deadline than the ordinary deadline for filing an injury lawsuit. A public school corporation is a political subdivision, so a potential claim against it is governed by the Indiana Tort Claims Act. Written notice to a political subdivision is generally required within 180 days of the loss under Ind. Code 34-13-3-8.
A tort claim notice is not a lawsuit. It is a separate written notice, and missing the applicable notice deadline can bar a claim. When your child is receiving lengthy medical care away from home, it can be difficult to focus on legal paperwork. A prompt review with an attorney familiar with school bus accident claims can help you identify the proper entity and the deadlines that may apply.
You should also determine who actually operates the bus. Some school corporations operate their own transportation departments, while others use contractors. The answer can affect who should receive notice and which insurance may apply.
Bus camera footage may be important. Many buses use cameras inside or outside the vehicle, and recordings can be overwritten. A timely written preservation request may help protect footage, vehicle information, training records, route records, and other evidence before it is lost.
You can also request the sheriff's crash report and ask whether the school corporation created a separate incident report. A crash report is not a final determination of civil liability. Families may find the firm's guide to obtaining an Indiana police crash report helpful when organizing those records.
The location and operation of the bus stop may matter too. Relevant questions can include where the stop was placed, why a bus needed to turn around in the parking lot, and whether more than one bus used the area at the same time. These questions do not establish fault by themselves, but they may guide the investigation.
Keep records of medical care, travel, lodging, missed work, and out-of-pocket costs. You do not need to decide immediately what every expense means legally. Clear records give your family and its advisers a reliable account of what happened over time.

Why Location Matters in Indiana Injury Claims
This crash happened in unincorporated Vanderburgh County, and the Vanderburgh County Sheriff's Office is the investigating agency. The location can affect venue, which government entities may be involved, and where records must be requested.
For a September 1, 2026 loss, the draft's 180-day calculation reaches the end of February 2027. If the State of Indiana were a defendant instead of a local political subdivision, written notice would generally be required within 270 days under Ind. Code 34-13-3-6. These notice rules should be evaluated promptly because the correct recipient and contents depend on the facts.
Most Indiana personal injury claims must be filed within two years under Ind. Code 34-11-2-4. The limitations period generally does not begin to run for a person under a legal disability, including a minor, until the disability is removed under Ind. Code 34-11-6-1. That tolling rule does not replace the separate Tort Claims Act notice requirement. The firm's guide to Indiana government tort claim notices explains why these deadlines must be considered separately.
Claims against a city, county, public school corporation, or another governmental entity are governed by the Indiana Tort Claims Act rather than the Comparative Fault Act, and fault attributed to the claimant can bar recovery. In an ordinary claim that does not involve a government entity, Indiana's modified comparative fault rule provides that an injured person whose fault is greater than 50 percent recovers nothing. Otherwise, recovery is reduced by that person's percentage of fault under Ind. Code 34-51-2-6. No public finding has determined how fault should be allocated in this crash.
A child's settlement generally requires additional safeguards, including court review of how settlement funds will be protected. Families should plan for that process rather than treating it as a final administrative detail.
